1. ACCEPTANCE OF TERMS

By visiting, accessing, or using https://www.realvalidito.com (the “Site”) or any associated API services, you accept and agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional terms incorporated herein by reference.

The term “you” or “Customer” refers to anyone who uses, visits, accesses, or purchases services from the Site, including free unregistered users and paid API/batch customers. “REALVALIDITO,” “we,” “us,” or “Company” refers to Realvalidito.com and all its divisions, subsidiaries, and affiliates.

We reserve the right to amend these Terms at any time. Changes will be posted on the Site with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. DESCRIPTION OF SERVICE

RealValidito provides real-time data validation and lookup services, including:

  • Phone Number Lookup — validate US & Canada phone numbers, identify line type, carrier, and status
  • DNC (Do Not Call) Lookup — check phone numbers against DNC registry data
  • Gender Lookup — determine likely gender from first name
  • ZIP/Postal Code Lookup — retrieve geographic and demographic information by ZIP or postal code

Services are available via web interface (free trial) and API (paid subscription). The Customer warrants that it is the end-user of the data provided by REALVALIDITO and will abide by all terms set forth herein.

3. RESTRICTED LICENSE

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your own internal business purposes only. You may not:

  • Resell, sublicense, or redistribute our data or services to third parties
  • Use our data to build a competing service or product
  • Reverse engineer, decompile, or attempt to extract our source code or data sources
  • Use automated scraping, harvesting, or bulk extraction beyond your authorized API access
  • Re-purpose or redistribute validated data in any form

We reserve the right to refuse service to any user at any time at our sole discretion.

4. RELIABILITY OF DATA

REALVALIDITO makes no warranty, express or implied, as to the reliability, accuracy, or completeness of its service or data. Data provided may contain errors, inaccuracies, false results, incompleteness, or omissions.

Customer acknowledges that:

  • Data is provided for informational purposes only and shall not be relied on without independent verification
  • All data is provided in “AS IS” condition and used at Customer’s sole risk
  • Customer shall have no legal or financial recourse against REALVALIDITO for defective, missing, incomplete, or inaccurate data

Service outages may occur due to system maintenance, crashes, or power outages. Customer agrees it shall have no recourse against REALVALIDITO for service interruptions.

5. FAIR CREDIT REPORTING ACT (FCRA)

REALVALIDITO is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA). Results obtained from this Site shall NOT be used for any FCRA-regulated purpose, including but not limited to:

  • Employment screening or background checks
  • Housing or tenant screening
  • Insurance underwriting decisions
  • Credit eligibility determinations

Any use of our data for FCRA-regulated purposes is strictly prohibited and is solely the Customer’s responsibility.

6. TELEPHONE CONSUMER PROTECTION ACT (TCPA)

REALVALIDITO assumes no legal liability for any phone records misidentified as the wrong line type under the Telephone Consumer Protection Act (TCPA) or similar federal or state consumer protection laws.

We make NO WARRANTY that numbers processed are Do Not Call (DNC) list compliant. REALVALIDITO makes no legal representations or offers no legal advice as to what may constitute lawful use of processed telephone numbers. Compliance with TCPA, DNC regulations, and applicable telemarketing laws is solely the Customer’s responsibility.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  • Neither REALVALIDITO, its officers, directors, employees, nor any third-party data providers shall be liable for any loss, claim, or damage arising from Customer’s use of our services
  • If liability is nonetheless assigned by a court of law, REALVALIDITO’s maximum liability shall not exceed USD $25.00 regardless of the nature, size, or scope of the claim
  • REALVALIDITO shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages
  • Customer agrees not to seek punitive damages against REALVALIDITO under any circumstances

REALVALIDITO provides its services on an “AS IS” and “AS AVAILABLE” basis, expressly disclaiming all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. INTELLECTUAL PROPERTY

All content on this Site including text, logos, graphics, files, materials, services, products, videos, audio, computer code, designs, and all other information (collectively, the “Content”) is owned by REALVALIDITO and protected by applicable intellectual property laws.

You are granted a limited, revocable license to access and use the Site for personal, non-commercial, informational purposes only. You may not copy, duplicate, steal, modify, publish, distribute, reproduce, store, transmit, sell, rent, or create derivative works from any Content without our prior written consent.

9. PRIVACY OF CUSTOMER DATA

All account information provided by Customer to REALVALIDITO shall be treated as confidential. We log and store Customer IP addresses and other identifying information as a record of service use and to identify abuse and fraud. 10. AUTOMATED SEARCHING

Automatic scraping or harvesting of data from this Site beyond your authorized API access is strictly prohibited. We do not permit data to be re-purposed or redistributed. Customers requiring bulk processing should use our authorized batch processing and API options. We reserve the right to terminate access for any user engaging in unauthorized automated access.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to conflict of law principles.

In the event of any dispute arising out of or relating to these Terms or your use of our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules.

You expressly waive any right to a jury trial or class action lawsuit in connection with any dispute arising from your use of the Site or services.

12. EU/EEA USERS — ADDITIONAL TERMS

If you are located in the European Union or European Economic Area, the following additional terms apply:

  • Data Processing: Where REALVALIDITO processes personal data on your behalf through our API services, we act as a Data Processor. You, as the Customer, act as the Data Controller and are responsible for ensuring your use of our services complies with GDPR and applicable EU data protection laws.
  • Data Processing Agreement (DPA): EU/EEA business customers requiring a formal Data Processing Agreement should contact us at contact@realvalidito.com.
  • Your Rights: You have rights under GDPR including access, rectification, erasure, portability, and objection. See our Privacy Policy for details.
  • Supervisory Authority: You have the right to lodge a complaint with your national data protection supervisory authority if you believe we have violated your data protection rights.

13. TERMS AND CONDITIONS FOR PAYPAL PAYMENTS

13.1. General

These terms apply to all PayPal payments made to REALVALIDITO for the purchase of Lookup Credits, whether made online, by telephone, or by any other means.

  • These terms also apply to all Electronic Communications in connection with PayPal payments
  • REALVALIDITO may amend these payment terms at any time by posting updates on the Site at least 30 days before the effective date of change
  • REALVALIDITO reserves the right to modify or discontinue services with or without notice. REALVALIDITO, its employees and owners, shall not be liable for any modification, suspension, or discontinuance of service
  • Even with a paid subscription, there are no guarantees or warranties of accuracy. Users assume all risk for any loss resulting from the use of the data or this Site
  • You agree to comply with the PayPal User Agreement and your cardholder agreement

13.2. Definitions

“Realvalidito” / “we” / “us”: Realvalidito.com and all its divisions, subsidiaries, and affiliates.

“You” / “Customer”: The individual or business entity making a purchase.

“Service”: Phone Lookup, DNC Lookup, Gender Lookup, and ZIP/Postal Code Lookup services provided by REALVALIDITO.

“Lookup Credits”: Phone Lookup Credits, DNC Lookup Credits, Gender Lookup Credits, or ZIP/Postal Code Lookup Credits issued to your REALVALIDITO account.

“Electronic Communications”: Online billing statements, payment confirmations, receipts, notices, and other communications sent electronically.

13.3. Delivery of Services

Purchased goods and services are considered delivered as soon as the purchased Lookup Credits become available in your REALVALIDITO account. Credits are typically applied immediately upon successful payment confirmation from PayPal.

13.4. No Refund Policy — IMPORTANT

REALVALIDITO DOES NOT ISSUE REFUNDS UNDER ANY CIRCUMSTANCES. ALL SALES ARE FINAL.

This is a digital service. Once Lookup Credits are issued to your account, they cannot be returned. No refunds will be issued for:

  • Legitimately and intentionally purchased Lookup Credits, whether used or unused
  • Credits consumed through API calls or web lookups
  • Purchases where the Customer claims they did not authorize the transaction after credits have been used or accessed
  • Disputes filed with PayPal after Lookup Credits have been delivered and used

Unauthorized Transaction Disputes: If a Customer uses Lookup Credits and then files an unauthorized purchase claim with PayPal, REALVALIDITO will provide PayPal with full transaction records, IP logs, account access logs, and API usage records demonstrating that the credits were delivered and used. REALVALIDITO reserves the right to terminate the account of any Customer who files a fraudulent chargeback claim.

If you believe your account has been accessed fraudulently by a third party, contact us immediately at contact@realvalidito.com before initiating any PayPal dispute. We will work with you to investigate and resolve legitimate unauthorized access issues.

13.5. Technical Requirements for Electronic Communications

To make online payments or receive Electronic Communications, you must have:

  • A personal computer or mobile device with a modern browser
  • Active internet access
  • A valid and current email address

You agree to keep your email address current with us. You confirm that your system meets these requirements by authorizing a PayPal payment online.

13.6. Electronic-Only Communications

All Electronic Communications from REALVALIDITO will be provided exclusively online and via email. No paper statements will be sent unless required by law.

14. THIRD-PARTY WEBSITES

The Site contains links to third-party websites. We have no control over the terms, privacy policies, or content of those sites. Please review those sites’ policies before providing personal information to them.

15. MODIFICATIONS TO SERVICE

REALVALIDITO reserves the right to modify, suspend, or discontinue any part of the service at any time with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuance.

16. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and REALVALIDITO regarding your use of the Site and services, and supersede all prior agreements and understandings.
